Georg Reitboeck focuses on patent litigation. He has experience in all phases and aspects of patent infringement cases in US courts. Having studied and practiced intellectual property law in both the United States and Austria, he is familiar with the legal systems and cultures of the United States and Europe. He has represented a number of German companies in US patent cases, and has counseled US clients in German patent infringement proceedings.

Dr. Reitboeck has been involved in numerous patent cases in the automotive industry, dealing with technologies related to electromechanical brake systems, semi-active suspension systems, multimedia and navigation systems, LED lighting, tire pressure monitoring systems, adaptive cruise control, headrests, and automotive sensors. He also has experience in the fields of printing presses, medical devices, and toys. Representative clients he has worked for include Volkswagen Group of America, Inc.; Mercedes-Benz USA, LLC; Goss International Americas, Inc.; and Mattel, Inc.

Prior to joining Kenyon & Kenyon LLP in 2003, Dr. Reitboeck practiced intellectual property law at one of Austria’s preeminent law firms for several years. He previously served as a law clerk at district and appellate courts in Vienna.

Georg Reitboeck earned a masters degree and a Ph.D. in law from Vienna University in 1997 and 2002, respectively, and an LL.M. from New York University in 2000. His doctoral thesis on the issue of employee inventions was published in 2003 and has been cited repeatedly by the Austrian Supreme Court. He has written on patent and trademark issues in various German- and English-language publications, and has spoken on US patent litigation in Austria.

Representative Matters:

MHL Tek, LLC v. Nissan Motor Co. et al., 2:07-cv-289-TJW (2010). Achieved dismissal of patent infringement claims on behalf of defendants Volkswagen AG, Audi AG, and Volkswagen Group of America, Inc. in an action concerning tire pressure monitoring systems. Successfully moved for dismissal for lack of standing with respect to two patents in the district court; the court of appeals affirmed. Successfully moved for non-infringement with respect to third patent in the district court; the court of appeals subsequently agreed with the Volkswagen companies that plaintiff MHL lacked standing with respect to the third patent as well.

Goss International America, Inc. v. MAN Roland Inc. et al., 1:03-cv-513-SM (2008). Achieved favorable settlement on behalf of plaintiff Goss International Americas, Inc. after obtaining summary judgment of patent infringement and summary judgment dismissing defendants' inequitable conduct defense, in an action concerning printing press technology.

Thebaud v. Mercedes-Benz USA, LLC, 1:06-cv-11199 (2007). Obtained early dismissal of patent infringement claims for lack of jurisdiction on behalf of defendant Mercedes-Benz USA, LLC in an action concerning automotive headrests.
