Select Recent Victories

  • Barnes & Noble. Kenyon defended Barnes & Noble in protecting its NOOK eReader products from claims of patent infringement made by Microsoft concerning various hardware and software patents in In the Matter of Certain Handheld Electronic Computing Devices.
  • Bosch.  Kenyon is helping to define the continued availability of injunctions after the U.S. Supreme Court’s eBay decision in Robert Bosch LLC v. Pylon Manufacturing Corp.
  • Sony. Kenyon achieved a favorable settlement for our client Sony in a high-profile dispute against LG Electronics, representing Sony in five U.S. litigations (including two ITC cases) involving patents pertaining to liquid-crystal display televisions and monitors, mobile phones and Blu-ray DVD technology.
  • Teva. Kenyon was lead counsel for plaintiffs Teva Pharmaceuticals USA, Teva Pharmaceutical Industries and Yeda Research and Development Co. in their victory to prevent Sandoz/Momenta and Mylan/Natco from infringing Yeda’s patents by marketing proposed generic versions of Teva’s blockbuster multiple sclerosis drug Copaxone®.
  • Makers’ Mark. Kenyon achieved a victory for Maker’s Mark in one of the most important trademark cases of 2012, a high-stakes battle against Cuervo and its distributor Diageo for the red dripping wax seal. The Sixth Circuit ruled that Maker’s Mark holds an “extremely strong” and enforceable trademark in the well-known dripping red wax seal atop its bottle. 
  • Toyota. Kenyon secured the right of our client Toyota to sell cars under the “LEXUS” name in Mead Data (LEXIS) v. Toyota.
